These Terms of Use ("Terms") govern your access to and use of the Zubi mobile application and related services (collectively, the "Service") provided by Zee Palm Private Limited ("we," "us," or "our").
Please read these Terms carefully. By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Zubi is a platform that lets you describe software you want — such as trackers, tools, or small games — and run personalized mini apps on your device. The Service uses automated systems, including artificial intelligence, to plan, generate, edit, and run apps for your account.
We may modify, suspend, or discontinue any part of the Service at any time, including features, models, or availability by region.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms on your behalf.
You represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at zubair@zeepalm.com if you believe your account has been compromised.
We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security, legal, or operational risk.
4. Your Content
"Your Content" means instructions, prompts, app names, generated apps, data stored through your apps, files, and other material you submit to or create with the Service.
You retain ownership of Your Content, subject to the rights you grant us below. You represent that you have all rights necessary to submit Your Content and that doing so does not violate any law or third-party rights.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, and use Your Content solely to operate, provide, maintain, and improve the Service, including to process it through AI systems and cloud infrastructure on your behalf.
5. AI-Generated Output
Output generated by the Service — including app code, text, images, and suggestions — may be inaccurate, incomplete, unsafe, or unsuitable for your intended purpose. You are solely responsible for reviewing, testing, and deciding how to use any generated output.
Because AI systems are probabilistic, similar inputs may produce different results over time. We do not guarantee that generated apps will be error-free, secure, compliant with third-party policies, or fit for any particular use.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Generate, store, or distribute illegal, harmful, abusive, harassing, defamatory, or deceptive content
- Attempt to access another user’s account, data, or apps
- Reverse engineer, scrape, probe, or interfere with the Service or its security measures, except where prohibited restrictions cannot be waived by law
- Circumvent usage limits, billing controls, or access restrictions
- Use the Service to build malware, spam tools, or systems intended to exploit or harm others
- Misrepresent AI-generated content as human-created where doing so would be deceptive or unlawful
We may investigate violations and remove content, disable apps, or terminate accounts as we deem appropriate.
7. Apps, Skills, and Third-Party Services
Apps you create may request device capabilities such as local storage, notifications, file sharing, or server-side skills that call external services. Your use of those capabilities is subject to these Terms and applicable device permissions.
The Service relies on third-party providers for authentication, hosting, AI, image generation, and other functions. Your use of those providers may also be subject to their separate terms and privacy policies.
If an app downloads content from an external URL or shares files through your device’s native share sheet, your interaction with third parties is between you and those third parties.
8. Fees and Paid Features
Some features, including certain server-side skills, may be subject to usage limits or fees in the future. If we introduce paid features, we will provide applicable pricing and payment terms before you are charged.
Unless required by law, fees already paid are non-refundable.
9. Intellectual Property
The Service, including its software, design, branding, and documentation (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding except as necessary to use the Service as intended.
10. Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT GENERATED OUTPUT WILL BE ACCURATE OR RELIABLE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, and indemnification.
15. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles, except where prohibited by the laws of your country of residence.
Except where mandatory local law requires otherwise, you agree that any dispute arising out of or relating to these Terms or the Service will be submitted to the exclusive jurisdiction of the courts located in Pakistan, and you consent to personal jurisdiction in those courts.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice within the Service or by other reasonable means. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.
17. General
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
